New deadlines and stages for status review
From now on, existing decisions recognizing enterprises as critically important will remain valid only for a specified period, but no later than September 1, 2026. State authorities and military administrations must conduct an analysis and update the criteria for determining critical enterprises by June 10 of the current year. By July 1, they must verify the compliance of organizations with the new requirements, and by September 1, review all previously adopted decisions regarding critical status.
“State authorities and military administrations must review the criteria for criticality by June 10, verify enterprises for compliance with the updated criteria by July 1, and review already adopted decisions by September 1”.
Change of criteria and increase in salary thresholds
If the criterion under which an enterprise received the status of critically important for the industry or community is removed from the list, such status must be revoked. The resolution also provides for an increase in the minimum wage for employees who can be reserved: now it is no less than 3 minimum wages, which amounts to 25,941 hryvnias.
For enterprises operating in areas of possible or active hostilities or in temporarily occupied territories, a separate, lower threshold has been established — no less than 2.5 minimum wages (21,618 hryvnias).
If an enterprise exceeds the established limit of reserved employees, it has 10 working days to submit an application for cancellation of the reservation through the “Diia” application. Such an excess has been officially defined for the first time as a basis for revoking the status of a critically important enterprise.
