OpenAI has won a legal battle against xAI, led by Elon Musk, concerning alleged employee poaching and breach of trade secrets. District Judge Rita F. Lin ruled to dismiss xAI’s lawsuit due to a lack of sufficient evidence of wrongdoing by OpenAI.

In her ruling, the judge emphasized that xAI failed to provide compelling evidence that OpenAI coordinated or encouraged the departure of eight employees who transitioned to competitors almost simultaneously. Allegations regarding the potential unauthorized removal of the company’s source code were also considered, but the court found no grounds for such claims.
The court found no evidence of illegal actions by OpenAI related to the transition of employees.
Specific episodes in the case involved the retention of work chats on personal devices, claims by former employees refusing to provide confidentiality documents after their termination, and attempts to access internal information after joining OpenAI. The court concluded that these circumstances did not support allegations of violations by the company itself.

Currently, xAI has not commented on the court’s decision, but the company has the right to file an amended lawsuit with additional details and evidence. This legal battle is part of a broader legal confrontation between OpenAI and Elon Musk, who is also one of OpenAI’s co-founders and currently heads xAI. Recently, tensions between the parties have only escalated, leading to new lawsuits and public statements.
In particular, a separate case regarding the transformation of OpenAI from a nonprofit organization to a commercial entity is expected to be reviewed by a jury in April 2026.
