The U.S. Equal Employment Opportunity Commission (EEOC) is conducting a comprehensive investigation into Nike Inc. The inquiry was prompted by allegations of systemic discrimination against white employees and job candidates, which may be a result of the company’s policy to enhance racial diversity within its workforce.

EEOC Investigation and Nike’s Employment Policy

The EEOC investigation has been ongoing since 2024, with new details emerging following the submission of relevant documents to a federal court in Missouri. According to commission representatives, Nike has not provided the full range of necessary data and has partially ignored court requests regarding mentorship and leadership development programs. In response, a Nike spokesperson emphasized that the company has already submitted thousands of pages of documentation and acted in good faith, calling the escalation of the situation “unexpected.”

“The U.S. Equal Employment Opportunity Commission accuses Nike of failing to provide sufficient information and ignoring part of the court requests,” the case materials state.

The core of the allegations involves a violation of Section VII of the Civil Rights Act of 1964. The EEOC is examining whether Nike’s goal of increasing the representation of minority leaders to 30% by 2025 has led to the discrimination of other employees during hiring, promotions, or internships. According to Bloomberg, in 2020-2021, Nike exhibited one of the highest rates of hiring non-white employees among leading corporations in the U.S.

Political Context of the Opposition to DEI Programs

The intensification of the investigation into Nike coincides with the policies of the Donald Trump administration, which declared the fight against corporate initiatives related to “diversity, equity, and inclusion” (DEI) as one of its key priorities. The President has repeatedly urged federal agencies to identify and halt practices that he believes are discriminatory against the white population of the U.S.

Currently, the EEOC has approached the court with a request to compel Nike to provide a complete range of information regarding its corporate mentorship and leadership programs. If the allegations against Nike are confirmed, this could set a significant legal precedent for reviewing employment policies in many other multinational companies that have implemented similar racial quotas.
