In Ukraine, there is a growing discussion surrounding the situation in which a father of five children was fined over 56,000 hryvnias for failing to timely pass the military medical commission (MMC) at the Desnyansky District Territorial Center for Recruitment and Social Support.

Changes in Legislation and New Requirements for Passing the MMC

Following the enactment of amendments to Ukrainian legislation regarding the social protection of military personnel and police officers on May 4, 2024, the statuses of “limited fitness for military service” and “unfit for military service in peacetime, limited fitness in wartime” were abolished. According to the new regulations, citizens who were recognized as limited fit for service by this date must undergo a repeat medical examination within nine months from the date these changes come into effect — that is, by February 4, 2025. In February 2025, the Verkhovna Rada extended the deadline for the repeat examination to June 5, 2025.

“Ukrainian citizens who were recognized as limited fit for military service before the amendments to the legislation on military duty and military service (before May 4, 2024) are subject to a repeat medical examination within 9 months from the date Law No. 3621 comes into effect. That is, by February 4, 2025, inclusive. In February 2025, the Verkhovna Rada extended the deadline for the repeat examination to June 5, 2025,” the publication states.

Fines and Deferrals: Clarification from the TCC

For failing to timely pass the MMC, the legislation provides for a fine ranging from 17,000 to 25,500 hryvnias. Passing the medical examination at this stage is only possible with a referral issued by the TCC and SP.

The territorial center explained that although the man has an official deferral as the father of five children, he is still required to undergo a repeat MMC, as the new legal norms apply to all citizens subject to military duty, regardless of deferral or reservation.

The fine amounting to over 56,000 hryvnias arose from the doubling of the base fine due to non-payment within 15 days and the transfer of the case to the enforcement service. In addition to the main fine, the enforcement service charges a 10% enforcement fee and costs associated with the proceedings.

Recently, the head of the President’s Office, Kyrylo Budanov, stated that there are serious problems with mobilization in Ukraine. He noted that despite the desire for victory, many citizens are trying to avoid service in the Armed Forces.

It is also noted that after the mobilization reform, the fate of about 2 million draft evaders remains uncertain.
