Advantages of Being a “Well-Known” Trademark
The recognition of a trademark as “well-known” in Ukraine is based on the provisions of the Law of Ukraine on the Protection of Rights to Marks for Goods and Services and international WIPO standards. This status opens up a number of significant advantages for brand owners:
- Cross-category protection. The brand is protected even in areas where the company does not operate, significantly expanding the boundaries of legal security.
- Absolute monopoly on the name. The trademark owner receives the exclusive right to prohibit the use of identical or similar names by other companies for any goods or services, even if they are not direct competitors.
- Protection against unfair competition. The status guarantees that other enterprises cannot use the reputation of a well-known trademark for their own benefit.
The official confirmation of the high recognition of Ukrainian brands is further evidence of their strength in the domestic market and underscores the effective legal protection against potential infringements and attempts to exploit their reputation by competitors.
It is also worth mentioning that over the past year, the revenues of leaders in the Ukrainian retail sector have increased by 22%, with the largest growth recorded in the “ATB-Market” chain.
