A consistent judicial practice is emerging in Ukraine in favor of content creators on the OnlyFans platform in disputes with tax authorities. Out of 94 court cases challenging tax penalties and reassessments, at least 27 have been resolved fully or partially in favor of the plaintiffs.

Increase in Favorable Decisions for OnlyFans Creators
The trend of issuing positive decisions for creators continues to grow steadily. Since the beginning of 2026, Ukrainian courts have already issued over ten rulings in favor of platform creators, with the highest number of decisions made during the winter months.
Grounds for Overturning Penalties and Regional Dynamics
The main argument in favor of the plaintiffs is procedural violations by tax authorities. Problems often arise due to incorrect notifications—documents were sent to outdated addresses, preventing taxpayers from adequately responding to audits. As a result, courts declare such audits illegal along with all their consequences.
Another significant factor is the insufficiency of the evidence base. Tax authorities primarily rely on information from foreign entities about potential payments; however, courts emphasize that such data cannot serve as proof of income without primary documents, such as bank statements or contracts.
The highest number of decisions in favor of plaintiffs has been recorded in the Odesa region, with active defense of creators also occurring in the Dnipropetrovsk region. In other regions, precedent practice has yet to be established.
During the proceedings, courts often annulled substantial amounts of reassessments. For example, in one case, tax liabilities exceeding 3 million UAH were canceled due to a lack of verified income information. In another instance, penalties were overturned due to a complete absence of primary documentation, while in some cases, technical errors or inaccuracies in the information used by tax authorities served as grounds for annulment.
Current judicial practice demonstrates an increasing control over compliance with procedural norms by regulatory bodies. Identified violations become grounds for decisions in favor of taxpayers, gradually changing the approach to the consideration of such tax disputes.
