Conditions for Payment of Unreceived Pension After the Death of a Pensioner
According to current legislation, the right to receive the unreceived pension primarily belongs to relatives who lived with the pensioner at the time of their death. If such individuals are absent or have not applied for payment within the specified period, the right to receive it passes to the heirs by law or by will.
“The amount of the pension that belonged to the pensioner and remained unreceived due to their death is paid for the month of death inclusive to family members who lived with the pensioner on the day of their death,” says the lawyer.
If a person did not live with the pensioner, the unreceived pension is included in the inheritance. In this case, its receipt is only possible through the process of inheritance, after the appropriate documents are formalized with a notary. The same rule applies if the application for payment is not submitted within six months from the date of inheritance opening.
What Documents Are Required to Receive the Pension of the Deceased
To receive the unreceived pension, one must apply to the authority that appointed the pension no later than six months from the date of inheritance opening. Along with the application, the following documents should be submitted:
- the death certificate of the pensioner;
- documents confirming family ties with the deceased;
- a document verifying the identity of the applicant.
According to Yevheniy Mastyuhin, the application can be submitted either in person or through the web portal of the Pension Fund of Ukraine. If the applicant is a dependent family member, additional documents confirming their dependency on the pensioner, as well as documents confirming cohabitation on the day of death, must also be provided.
In cases where the unreceived pension is part of the inheritance, the heir must submit to the Pension Fund:
- a document verifying their identity;
- the death certificate;
- a certificate of inheritance rights issued by a notary.
If the pensioner received their pension in another country, the legislation of that country where the pension was appointed applies.
