Owners of Destroyed Housing Exempted from Utility Payments

The President of Ukraine, Volodymyr Zelensky, has signed a law that exempts owners of damaged or destroyed housing from paying for housing and utility services and establishes a new procedure for accounting for losses caused by the damage or destruction of real estate.

Main Provisions of the Law Regarding Utility Payments

The new law regulates the issue of exempting housing owners from paying for the management services of apartment buildings if the housing has become uninhabitable due to damage or destruction. From now on, owners of such properties are not required to pay for utility services during the period when the building cannot be used for its intended purpose. This applies to cases of damage or destruction of property due to hostilities, terrorist acts, or sabotage caused by Russia’s armed aggression against Ukraine.

The purpose of the document is to regulate at the legislative level the issue of exempting housing owners from paying for the management services of apartment buildings in the event of their damage or destruction, which has led to the impossibility of their further operation, during the period of their restoration.

Recording of Damages and Interaction of Authorities

The law defines the procedure for accounting for damages incurred by property owners as a result of armed aggression. Clear rules for interaction between authorities, building managers, and utility service providers have been established, particularly regarding the recording of damages and the suspension of utility payment accruals.

The relevant provisions of the law apply during the period of martial law and for one year after its completion or cancellation. The implementation of this initiative guarantees citizens the right not to pay for the management services of apartment buildings if their operation has become impossible due to damage or destruction.
