New Fines for Trespassing on Military Facilities Planned in Ukraine

The Cabinet of Ministers of Ukraine has approved a draft law that proposes amendments to the Code of Ukraine on Administrative Offenses (KUpAP) regarding the establishment of administrative responsibility for unauthorized entry into military facilities. Details of the Legislative Initiative

During a government meeting held on September 3, the draft law “On Amendments to the Code of Ukraine on Administrative Offenses Regarding the Establishment of Responsibility for Unauthorized Entry into Military Facilities” was supported. The document proposes to add a new article 186-9 to the KUpAP, which regulates the responsibility of citizens for such offenses.

According to the draft law, administrative responsibility will be established for:

  • unauthorized entry onto the territory of military facilities;
  • repeated commission of such an offense within one year;
  • committing such actions during a special period.

Amount of Fines and Procedural Powers

For unauthorized entry into military facilities, offenders are expected to be fined amounts ranging from 500 to 3,000 non-taxable minimum incomes of citizens, which currently amounts to between 8,500 and 51,000 hryvnias. Additionally, the confiscation of tools used to commit the offense may be applied.

The preparation of protocols for administrative offenses under this article is proposed to be entrusted to the National Police. Cases regarding such offenses will be considered by judges of district, city, or city-district courts.
