Court documents indicate that the charges, approved by a grand jury in the Eastern District of North Carolina, relate to threats made against U.S. President Donald Trump. This incident marks the second attempt by the current administration to hold Comey criminally accountable — he remains one of the main opponents of the sitting president.

The impetus for the new case was a post on Instagram in which James Comey shared a photo of shells arranged to form the numbers “86 47.” In U.S. slang, the number 86 is associated with getting rid of something, while 47 refers to the ordinal number of Trump’s presidential term. In the caption, Comey noted: “Cool cluster of shells during my beach walk.”

After a wave of criticism from Republicans and the Trump administration, who labeled his post a threat against the president, Comey deleted the post. He stated that he was unaware of possible interpretations of the numbers as a call to violence and emphasized that he opposes any form of violence.

“I remain innocent. I am still not afraid,” Comey said. “And I still believe in the independence of the federal judiciary, so let’s get started.”

James Comey is expected to voluntarily appear in federal court in the Eastern District of Virginia for further investigative actions. A warrant for his arrest has already been issued, but legal experts are skeptical about the prospects of criminal prosecution. In particular, it is believed that proving the intentional nature of the threats against the president will be necessary for the charges.

James Comey’s Career and Conflict with the Trump Administration

James Comey made a name for himself as a federal prosecutor in New York in the early 2000s, and from 2004 he became known for refusing to revive a program of surveillance on citizens without judicial approval. In 2013, President Barack Obama appointed him as FBI Director, a position he held until May 2017. At that time, President Trump unexpectedly fired Comey, accusing him of incompetence.
