Prosecutor from Zaporizhzhia Achieves Pension Increase to UAH 49,400 through Court

Andrii Kudriavtsev, a prosecutor from the Zaporizhzhia Regional Prosecutor’s Office, has received a pension increase from UAH 31,300 to UAH 49,400 following a decision by the Zaporizhzhia District Administrative Court. The court hearing took place within the framework of case No. 280/2595/25.

Restrictions on Pensions for Special Pensioners

According to the case materials, pensions for special pensioners who have not participated in the war between Russia and Ukraine since 2014 (since the beginning of the ATO) were restricted. If the assigned pension exceeded UAH 23,600, the amount of payments was reduced by applying decreasing coefficients. As stated in the documents,

“As seen from the case materials, the amount of the plaintiff’s pension was UAH 49,444.07. From January 1, 2025, the plaintiff began receiving a pension in a lesser amount than previously received. The pension amount from January 2025 is UAH 33,373.91. In response to the plaintiff’s request, a letter dated March 21, 2025, No. 4461/3877/K-02/8-0800/25, the defendant, in particular, informed that considering the resolution of the Cabinet of Ministers of Ukraine dated January 3, 2025, No. 1, the pension from January 1, 2025, to be paid is UAH 31,373.91”.

According to Andrii Kudriavtsev’s declaration, in 2024, his average monthly salary was UAH 103,500, while his pension was UAH 44,600 per month.

Court Decision on Restoring Payments

The court, having considered Kudriavtsev’s lawsuit, annulled the application of restrictive coefficients to his pension. Thus, the prosecutor’s payments were restored to the previous level of UAH 49,400. The court’s decision states that the Main Department of the Pension Fund of Ukraine in Zaporizhzhia Oblast must recalculate and pay the pension from January 1, 2025, based on 90% of the salary indicated in the certificate from the regional prosecutor’s office dated March 5, 2020, without limiting the maximum base for calculation.

It should be noted that from the beginning of 2025, pensions for special pensioners who have not participated in the defense of the country since 2014 were reduced. The changes affected only those whose pension exceeds 10 living wages (UAH 23,610), specifically cutting the portion that exceeds this amount by applying special coefficients. The restrictions affected 17,700 pensioners, and already hundreds of them have turned to the courts demanding the full amount of payments be restored. Nearly 840 court decisions regarding this resolution have been recorded, with the majority in favor of the pensioners.
