Ukrainians and Companies Will Have the Right to File Claims for Damages from Russian Aggression to an International Commission

The Parliamentary Assembly of the Council of Europe has approved a draft convention that provides for the establishment of an International Commission to review Ukraine’s claims against the Russian Federation. This body will become a key element of the compensation mechanism for damages caused by Russian aggression and will allow not only the state of Ukraine but also citizens and legal entities to file claims.

The International Commission will operate as the second stage of the existing compensation mechanism, which was initiated after the establishment of the Register of Damages from Russian Aggression in 2023. It will complement the work of the European Court of Human Rights and the future special tribunal for the crime of aggression. The Commission’s decisions will be final, forming the legal basis for compensation payments to victims.

Timeframes and Funding Issues

It is particularly emphasized that the Commission will consider claims not only regarding events after February 24, 2022, but also concerning all instances of Russian aggression against Ukraine, starting from February 20, 2014. The issue of funding for future compensation has not yet been definitively resolved. In this context, the Assembly has called on member states to work towards the creation of an international compensation fund, particularly through the use of frozen Russian assets.

It will address compensation issues for Ukrainians for damages caused by Russian aggression. The Commission will serve as the second stage of the compensation mechanism initiated after the establishment of the Register of Damages from Russian Aggression in 2023. It will complement the work of the European Court of Human Rights and the future Special Tribunal for the Crime of Aggression. This new instrument will allow claims to be filed not only against the state of Ukraine but also by individuals and legal entities.
