The Ukrainian Government Expands the List of Damages Eligible for Compensation Due to Russian Aggression

The Ukrainian government has made a decision to expand the list of categories of damages that are subject to official registration in the International Register of Damages for further compensation due to the aggression of the Russian Federation. This was announced by Prime Minister Yulia Svyrydenko.

New Categories of Damages for Citizens, Businesses, and the State

As Svyrydenko noted, the expanded list provides that citizens, business owners, and the state of Ukraine will be able to document the harm and losses caused by Russia’s actions after February 24, 2022, under 14 new categories. Applications for these new categories will be accepted after they are opened in the “Diia” app. Currently, registration is already available for 21 categories of damages.

“The government has expanded the list of categories under which citizens, business owners, and the state of Ukraine can officially document the harm and losses caused by Russian aggression after February 24, 2022. An additional 14 new categories will be added to the categories regulated by the decree,” she stated.

In particular, citizens will be able to document losses such as:

  • loss of access to medical care,
  • loss of access to education,
  • other violations of international humanitarian law, human rights, laws and customs of war, as well as additional economic losses.

Business owners will have the opportunity to document losses from the loss of cultural objects, costs for the evacuation of assets, as well as other economic and humanitarian damages.

The state, in turn, will document the destruction of cultural heritage sites, environmental damage, theft of natural resources, humanitarian expenses to support the affected population, as well as costs for demining and clearing territories.

International Cooperation and the Work of the Commission

The convention for the establishment of the International Commission for the Review of Claims has currently been signed by 38 countries and the European Union. The International Commission will verify, assess, and make decisions on claims submitted to the register of damages, as well as determine the amount of compensation in each individual case.

According to the Council of Europe, 44 states and the EU have already joined the register of damages. The mechanism for obtaining compensation continues to operate, and the number of applications submitted for reimbursement has already exceeded 150,000.
